What is the impact of companies act 2008 on the natal code of zulu law 1987 and the kwazulu act 1985 on the code of zulu law?

Both the Natal Code of Zulu Law (Proc R151 of 1987) and the KwaZulu Act 16 of 1985 on the Code of Zulu Law (the Codes), were assigned to KwaZulu-Natal by the President vide Proclamation No 107 of 17 June 1994.

Section 53(1) of the KwaZulu-Natal Leadership and Governance Act 2005 provides that the repeal of the KwaZulu Act 1985 on the Code of Zulu Law and the Natal Code of Zulu Law 1987 takes effect on a date determined by the responsible Member of the Executive Council by Notice in the Gazette (KwaZulu-Natal Traditional Leadership and Governance Bill of 2015).

The new KwaZulu-Natal Traditional Leadership and Governance Bill (“the Bill”) which is intended to repeal the current KwaZulu-Natal Traditional Leadership and Governance Act 2005 faces substantial opposition to the repeal of the Codes amongst Traditional Leaders and ordinary members of Traditional communities (KwaZulu-Natal Traditional Leadership and Governance Act No 5 of 2005).

The Bill is currently with the Portfolio Committee of the Department of Co-operative Governance and Traditional Affairs.
